Terms of Service

Effective date: April 7, 2026

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the uptime.cx platform, including the website at uptime.cx, associated APIs, and related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

"We," "us," and "uptime.cx" refer to the operator of the Service. "You" refers to the individual or entity accessing the Service.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly at support@uptimecx.com if you suspect unauthorized access.

Authentication is provided through our third-party identity provider (Clerk). You may also be subject to Clerk's terms of service when using single sign-on or social login features.

4. Service Description

uptime.cx is a reliability intelligence platform for Amazon Web Services (AWS). The Service connects to your AWS account(s) using read-only IAM roles, collects resource configuration data, analyzes infrastructure for reliability risks, and presents findings with remediation guidance.

Key capabilities include:

  • Read-only AWS resource discovery across multiple regions
  • Automated reliability analysis (single points of failure, missing backups, alarm gaps)
  • AI-assisted analysis using third-party large language models
  • Interactive topology visualization and blast radius mapping
  • Risk drift detection between scans
  • Executive reporting and PDF export
  • Scheduled rescans and health checks

5. AWS Access and Permissions

The Service requires you to deploy a CloudFormation stack in your AWS account(s) that creates a read-only IAM role. This role grants the Service permission to describe and list resources in your account. The Service does not create, modify, or delete any resources in your AWS environment.

You are responsible for reviewing the IAM policy before deploying the CloudFormation stack. You may revoke access at any time by deleting the stack from your AWS account.

6. Plans and Payment

The Service offers free and paid subscription plans. Paid plans are billed monthly on a per-connected-AWS-account basis. Prices are displayed on the pricing page at the time of purchase.

Payments are processed through Stripe. By subscribing to a paid plan, you also agree to Stripe's terms of service. You may cancel your subscription at any time through the billing settings or Stripe Customer Portal. Cancellation takes effect at the end of the current billing period.

We reserve the right to change pricing with 30 days' advance notice. Price changes do not apply retroactively to the current billing period.

7. Your Data

You retain all rights to data you provide to the Service, including AWS configuration data collected through the IAM role. We process this data solely to provide and improve the Service as described in our Privacy Policy.

Upon account deletion or at your request, we will delete your data within 30 days, except where retention is required by law or for legitimate business purposes (such as fraud prevention or billing records).

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse-engineer, decompile, or disassemble the Service
  • Use the Service to compete directly with uptime.cx
  • Share account credentials with unauthorized third parties
  • Circumvent usage limits, rate limits, or plan restrictions
  • Transmit malicious code or attempt to disrupt the Service

9. Intellectual Property

All rights, title, and interest in and to the Service (including software, design, trademarks, and documentation) remain with uptime.cx. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service in accordance with these Terms.

10. Third-Party Services

The Service integrates with third-party services including AWS, Clerk (authentication), Stripe (payments), and Google AI (language model analysis). Your use of these services is subject to their respective terms and policies. We are not responsible for the availability or conduct of third-party services.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FINDINGS OR RECOMMENDATIONS WILL BE COMPLETE OR ACCURATE.

The Service provides informational analysis and recommendations. It is not a substitute for professional infrastructure review, disaster recovery planning, or compliance auditing. You are solely responsible for decisions made based on the Service's output.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPTIME.CX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless uptime.cx and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of laws provisions.
